Draft Western Cape Commissioner for Children Bill 2017

The Constitution of the Western Cape states that the Western Cape Government (WCG) must appoint a Commissioner for Children to "assist the WCG in protecting and promoting the interests of children in the Western Cape, particularly in respect of health services, education, welfare services, recreation, amenities and sport."

As described in the Provincial Constitution, the Commissioner for Children has the power, as regulated by provincial legislation, to fulfil this function through monitoring, investigating, researching, educating, lobbying, advising and reporting on issues relating to children. 

The Western Cape Commissioner for Children is duty-bound to report to the Provincial Parliament annually on measures taken by the WCG to protect and promote the interests of children in the Western Cape. The Commissioner may also report to Provincial Parliament at any other time.

A draft Bill was published to introduce a provincial Commissioner for Children. The Bill prescribes the qualifications required to fulfil this role and will lead to the fair appointment of a Western Cape Commissioner for Children. The Bill also outlines the functions, powers and accountability of the Commissioner and clarifies financial matters related to the provincial Commissioner for Children, as well as any other related matter.
